Privacy Policy

This Privacy Policy explains how FrenchExam.ie, operated by Nicola Rowan at Greenbank Road, Carlow, Ireland, collects and uses personal data under the General Data Protection Regulation (GDPR), the Data Protection Act 2018 and other applicable Irish law.

1. Who controls your data?

FrenchExam.ie is the data controller for personal data collected directly through this website and the FrenchExam.ie programme.

2. Information we may collect

• Purchaser and account information, such as name, email address and login details.
• Limited student information, such as name and school year, where needed to provide the programme.
• Purchase, payment-status and transaction records. FrenchExam.ie does not receive or store full payment-card details.
• Newsletter, waiting-list and free-resource registrations.
• Messages, support requests and other communications sent to us.
• Technical and usage information, such as device or browser information, pages viewed, cookie identifiers and approximate location derived from an IP address, where permitted.

4. Children and young people

FrenchExam.ie is intended primarily for Higher Level Leaving Certificate students, including young people under 18. We apply a high level of privacy protection to all student information.

• Where a student is under 18, enrolment must be completed by a parent or legal guardian, who accepts the Terms and supplies the purchaser's contact and payment details.
• The student may use the course account with the parent or guardian's knowledge and permission.
• A person must be at least 16 to subscribe using their own email address. For a user under 16, a parent or guardian should subscribe on their behalf using the adult's contact details.
• We do not use children's data for profiling or targeted advertising.
• We do not knowingly publish a student's image, identifiable testimonial or recording without appropriate permission.

5. Email marketing

If you consent to marketing, MailerLite may be used to deliver requested resources, French language tips and programme information. Every marketing email includes an unsubscribe facility. Withdrawing marketing consent does not affect essential account, payment or service messages.

6. Service providers and other recipients

We use trusted services to operate the website and programme. Depending on how you interact with us, these may include:

• Systeme.io — checkout, course accounts, members-area access and related communications.
• Stripe and other checkout payment providers — secure payment processing and fraud prevention.
• Payhip — sale and delivery of digital and printed FrenchExam.ie notes.
• MailerLite — mailing lists, forms, popups, email delivery and automation.
• Google Analytics — consent-based website measurement.
• Letshost and associated technical providers — domain, website hosting and infrastructure.

Some providers may act as processors on our instructions, while others may act as independent controllers for particular activities, such as payment security, tax or legal compliance. Their own privacy notices also apply when you use their services.

7. International transfers

Some providers may process personal data outside Ireland or the European Economic Area. Where an international transfer occurs, we rely on an appropriate legal transfer mechanism, such as an adequacy decision, European Commission Standard Contractual Clauses, or another safeguard permitted by data-protection law.

8. Retention

We retain information only for as long as reasonably necessary for the purpose for which it was collected:

• Course and account records are normally retained for the period of access and a limited period afterwards for support and dispute management.
• Financial and transaction records may be retained for six years or longer where required by tax, accounting or legal obligations.
• General enquiries are normally deleted when no longer needed, usually within 12 months.
• Marketing information is retained until consent is withdrawn or the record is removed through periodic list review.
• Cookie information is retained for the periods described in the Cookie Policy below.

9. Your rights

Depending on the circumstances, you may have rights to access, correct, erase or restrict personal data; object to certain processing; receive portable data; and withdraw consent. Children have data-protection rights in their own right where they have the capacity to exercise them and doing so is in their best interests.

We use reasonable technical and organisational measures to protect personal data. No online system can be guaranteed completely secure. We may update this policy to reflect legal, technical or service changes and will post the revised date on this page.

Cookie Policy

Cookies and similar technologies are small files or identifiers used to operate websites, remember choices and understand website use.

Necessary and non-essential technologies

Strictly necessary technologies may operate without consent where required to provide a service requested by the user. Analytics, advertising and other non-essential technologies are used only after consent. Refusing non-essential cookies does not prevent access to the public website.

Cookie names and durations can change when providers update their services. Third-party checkout, course and shop pages may set their own cookies under their respective policies.

You may accept or reject non-essential cookies using the website's cookie controls and may change your preference later. Browser settings can also delete or block cookies, although blocking necessary technologies may affect website functions.

Terms & Conditions

These Terms apply to purchases of and access to FrenchExam.ie programmes. By purchasing, the purchaser agrees to these Terms. Nothing in these Terms limits rights that cannot lawfully be excluded under Irish consumer law.

1. Trader information

FrenchExam.ie is an online Higher Level Leaving Certificate French programme operated by Nicola Rowan trading as FrenchExam.ie. Business correspondence address: Greenbank Road, Carlow, Ireland. Contact: bonjour@frenchexam.ie. Email is the primary contact channel.

2. Purchasers under 18

A student under 18 may use the programme only where a parent or legal guardian completes the enrolment, agrees to these Terms and authorises the student's use. The parent or guardian is the purchaser and is responsible for the accuracy of enrolment information and the payment obligations.

3. Programme description

FrenchExam.ie provides prerecorded video lessons, notes, workbooks and educational resources for Higher Level Leaving Certificate French. Under the Weekly Programme, lessons are released according to the published schedule. The Intensive Revision Programme provides access on the basis described on the sales page at the time of purchase.

4. Prices and payment

• Full Year Access — €188: one payment for programme access through the end of the relevant Leaving Certificate examinations.
• Fixed Payment Plan — eight instalments of €24 (€192 total): this is payment of one total course fee by instalments, not a cancel-anytime monthly subscription. Subject to statutory cancellation and termination rights, the remaining instalments continue to be payable after the cancellation period even if the student stops using the programme.
• Intensive Revision Programme — €188: one payment for the access described on the sales page, normally available after closure of the Weekly Programme.

The price and programme description shown at checkout form part of the contract. Failed instalments may be retried by the payment provider. Access may be suspended while an amount is overdue, following reasonable notice, without removing amounts properly due under the fixed payment agreement.

5. Statutory 14-day right to cancel

A consumer who purchases online normally has 14 days from the date the contract is concluded to cancel without giving a reason. To exercise this right, the purchaser must send a clear cancellation statement to bonjour@frenchexam.ie before the period expires. The model form below may be used but is not compulsory.

Where the purchaser expressly requests that a digital service begin during the 14-day period, a lawful proportionate charge may apply for what has been supplied before cancellation. Where legally permitted for digital content supplied immediately, the cancellation right may be lost after supply begins only where the purchaser has given the required prior express consent and acknowledged the effect on the right to cancel.

Any refund legally due following withdrawal will be made without undue delay and no later than 14 days after FrenchExam.ie is informed, using the original payment method unless another method is agreed.

6. Refunds after the cancellation period

After the statutory cancellation period has expired, programme fees are not refundable merely because a purchaser changes their mind, the student stops studying French or does not use the programme. This does not affect statutory remedies where the programme is not supplied, does not conform to the contract, cannot be accessed and is not remedied within a reasonable time, or where another legal right to terminate applies.

7. Access and accounts

• Access is normally provided through the Systeme.io members area following successful payment.
• Access is for one registered student and continues for the period stated at purchase.
• The purchaser must provide accurate information and keep login details secure.
• Planned maintenance and events reasonably outside our control may occasionally affect access. We will take reasonable steps to restore access.

8. Acceptable use and intellectual property

All lessons, videos, notes, PDFs, workbooks, graphics, branding and related material are owned by Nicola Rowan or used with permission. A limited, personal, non-transferable right to use the material is granted to the registered student for private study.

Users must not share accounts; reproduce, upload, resell or distribute course material; circumvent access controls; or record content for publication or distribution. A serious or repeated breach may result in proportionate suspension or termination of access, following notice where appropriate. This does not affect statutory rights.

9. Educational scope

The programme is educational support intended to complement school learning. No particular examination result is promised or guaranteed. Results depend on many factors, including student participation and examination performance.

10. Changes to the programme

We may make reasonable updates that maintain or improve content, accuracy, security or delivery. If a change materially and negatively affects a consumer's access or use beyond what the contract permits, statutory rights may apply. Significant changes will be communicated where appropriate.

11. Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights. Subject to that qualification, FrenchExam.ie is not responsible for indirect loss that was not reasonably foreseeable when the contract was made.

12. Governing law and contact

These Terms are governed by Irish law. Consumers retain any mandatory protections and rights regarding jurisdiction available to them under applicable law. Questions or complaints should first be sent to bonjour@frenchexam.ie.
